Terms of Service

Effective June 19, 2026 · The rules of the road for being a High Noon BJJ member.

These Terms of Service (“Terms”) govern your use of the services provided by High Noon BJJ & Fitness LLC (“High Noon BJJ,” “we,” “us,” or “our”), including in-person instruction at our academy, the member.highnoonbjj.com website, and the SMS messaging program described below. By becoming a member or using our services, you agree to these Terms.

1. Membership

Membership at High Noon BJJ is subject to a separate Membership Agreement that includes a waiver of liability and assumption of risk. You must be at least 18 years old to sign, or have a parent or legal guardian sign on your behalf if you are a minor. We reserve the right to refuse or terminate memberships in accordance with our published policies and applicable law.

2. Payment & cancellation

Memberships are billed on a recurring basis (weekly, or paid in full depending on the plan you select) through our payment processor, PaySimple. By providing payment information, you authorize us to charge the applicable fees until you cancel in writing. Cancellation terms and any applicable notice periods are described in your Membership Agreement.

3. Code of conduct

You agree to follow gym etiquette, instructor direction, and reasonable safety instructions, including tapping promptly when caught in any submission. Disruptive, unsafe, or disrespectful behavior may result in suspension or termination of membership without refund.

4. SMS messaging program

High Noon BJJ operates an SMS messaging program for members and prospective members. Enrollment requires explicit opt-in consent — you are only enrolled if you check the SMS-opt-in box during online signup at member.highnoonbjj.com/join, consent in person at the front desk, or text one of our opt-in keywords to our number. Consent is not a condition of membership or any purchase, and is recorded with a timestamp in our database.

Program description
Operational notifications: class reminders and schedule changes, event announcements (open mats, seminars, competitions), account and billing notifications, and occasional academy updates from staff.
Message frequency
Message frequency varies and is typically fewer than four messages per month.
Message & data rates
Message and data rates may apply, depending on your mobile plan. Check with your wireless carrier for details.
Opt-in keywords
Text START, JOIN, UNSTOP, or YESto our number to opt in by SMS. After opting in you will receive a one-time confirmation: “High Noon BJJ: You’re opted in to receive class reminders, schedule changes, billing alerts, and occasional academy updates. Msg freq varies. Msg & data rates may apply. Reply HELP for help, STOP to cancel.”
Opt-out keywords
Reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to any message at any time. You will receive one final confirmation that you have been unsubscribed, and no further messages will be sent.

Privacy
We do not sell, rent, or share your mobile phone number, SMS consent, or message content with third parties for marketing or promotional purposes. The only third-party processor is our SMS delivery provider (Twilio). See our Privacy Policy.
Supported carriersAT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, U.S. Cellular, MetroPCS, Virgin Mobile, Cricket, Alltel, Cincinnati Bell, and other major U.S. carriers. Wireless carriers are not liable for delayed or undelivered messages.

5. Intellectual property

All content on our website and instructional materials (curriculum descriptions, course materials, videos, photographs, and the High Noon BJJ name and logo) is owned by High Noon BJJ or licensed for our use. You may not copy, reproduce, or redistribute this content without our prior written consent.

6. Assumption of risk & release

Brazilian Jiu Jitsu, Judo, and submission grappling are contact sports with inherent risk of injury. You voluntarily assume all such risks when training at High Noon BJJ. Subject to applicable law, you release High Noon BJJ, its owners, instructors, and staff from any claim arising from your participation in classes or use of the facility, except for claims caused by gross negligence or willful misconduct. Full release language is set forth in your Membership Agreement.

7. Limitation of liability

To the maximum extent permitted by law, High Noon BJJ’s aggregate liability arising out of or relating to these Terms or the services will not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim. In no event will we be liable for indirect, incidental, special, consequential, or punitive damages.

8. Changes to these Terms

We may update these Terms from time to time. The “Effective” date at the top reflects the latest revision. Material changes will be communicated by email or SMS where appropriate.

9. Governing law

#governing-law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. Any dispute arising from or relating to these Terms or the services will be brought exclusively in the state or federal courts located in Alexandria, Virginia, and you consent to the personal jurisdiction of those courts.
